1. Introduction

These Terms and Conditions ("Terms") govern the use of services provided by AIC Cloud, a brand of AIC Cloud ("Company", "we", "us", or "our"). By purchasing, accessing, or using any service from AIC Cloud — including but not limited to VPS hosting, shared hosting, dedicated servers, cloud GPU, application hosting, domains, email, and related services — you agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use our services.

2. Definitions

  • "Company" refers to AIC Cloud.
  • "Services" refers to all products, software, APIs, and cloud infrastructure offered by AIC Cloud.
  • "Customer" or "User" refers to any individual or entity that accesses or purchases our Services.
  • "Content" refers to data, files, code, applications, and any other material uploaded to or generated on our infrastructure by the Customer.

3. Services Provided

AIC Cloud provides Virtual Private Servers (VPS), shared hosting, dedicated servers, cloud GPU rental, application hosting, domain registration, email hosting, and related cloud infrastructure services. Our infrastructure is backed by enterprise-grade hardware and networking equipment across multiple regional datacenters. While we make significant investments to ensure service stability and reliability, no hosting provider can guarantee uninterrupted service under all circumstances.

4. Account & Eligibility

  • You must be at least 18 years old, or of legal age in your jurisdiction, to purchase or use our services.
  • You are responsible for maintaining the confidentiality of your account credentials.
  • You are responsible for all activity that occurs under your account, including actions by any user, script, or third party you grant access to.
  • Providing false, misleading, or fraudulent information during signup may result in immediate termination without refund.

5. Payment Terms

  • All payments are processed securely through Razorpay and other supported payment gateways.
  • Prices are displayed in Indian Rupees (INR) unless otherwise stated.
  • Subscription fees are billed in advance for the selected billing cycle (monthly, 6-month, or annual).
  • Renewals are automatically deducted from your AIC Cloud wallet if a sufficient balance is available on the renewal date.
  • Failure to maintain a sufficient wallet balance may result in service suspension after the grace period.
  • All fees are non-refundable except as expressly stated in Section 6 (Refund Policy).

6. Refund Policy

All AIC Cloud services are STRICTLY NON-REFUNDABLE by default, including VPS, Cloud GPU, Dedicated Bare-Metal Servers, Shared Hosting, Domains, Email Hosting, Storage, Dedicated IPv4 Add-ons, SSL Certificates, Renewals, and all other services. This applies whether the service is used, unused, spun down early, or the customer changes their mind after purchase.

The only exception where a refund may be issued is when an infrastructure-side failure on AIC Cloud's end makes the service completely undeliverable — for example, a failed provisioning where the resource was never usable, or a hardware fault that we are unable to remediate. In such cases, the refund amount is calculated for the affected period only and is credited to the customer's AIC Cloud wallet.

  • Refunds are not provided for change of mind, misconfigured customer workloads, application-level errors, incorrect self-service actions (accidental deletion, wrong OS install, wrong port configuration, etc.), or dissatisfaction with performance that meets the plan's advertised specifications.
  • Refunds are not provided for downtime, network incidents, upstream provider outages (DNS registry, GPU marketplace, payment gateway, etc.), or force majeure events.
  • Cloud GPU rentals, Dedicated Bare-Metal Servers, and Domain Registrations are strictly non-refundable once payment is captured, since capacity/registry allocations are reserved upstream and cannot be reversed.
  • Refund requests must be submitted via a support ticket on the AIC Cloud dashboard, with the specific infrastructure failure clearly described and reproducible from our monitoring. Requests made through WhatsApp, email, or social media outside the dashboard may not be processed.
  • Approved refunds are issued to the customer's AIC Cloud wallet balance only — never reversed to the original payment source. Wallet credit can be used to purchase or renew any AIC Cloud service.
  • Cases involving abuse, terms violation, chargeback, or repeated refund requests are not eligible.

7. Service Availability & Uptime

AIC Cloud makes reasonable and commercially practical efforts to maintain high uptime and service availability. However, uptime is not contractually guaranteed, and no service credits or refunds are automatically issued for downtime. AIC Cloud shall not be held liable for service interruptions caused by factors including but not limited to:

  • Network failures or internet backbone disruptions
  • Hardware failures (including but not limited to disk, memory, CPU, or network card failures)
  • Datacenter incidents or power outages
  • Targeted cyber attacks, DDoS attacks, or intrusion attempts
  • Software or operating system failures
  • Scheduled or emergency maintenance
  • Actions by upstream network or infrastructure providers
  • Government orders, regulatory actions, or lawful takedown notices
  • Force majeure events described in Section 8

8. Force Majeure

AIC Cloud shall not be liable for any failure or delay in performance caused by events beyond our reasonable control, including but not limited to: natural disasters (earthquakes, floods, fires, storms, cyclones), war, civil unrest, cyber warfare, terrorist attacks, pandemics, epidemics, government restrictions or orders, datacenter failures, internet outages, and major infrastructure failures. These events shall be considered Force Majeure, and no liability shall arise from them.

9. Backups & Data Responsibility

The customer is solely responsible for maintaining backups of their own data. AIC Cloud offers optional backup add-ons on selected plans, but unless a specific backup product has been purchased and is active on the account:

  • AIC Cloud does not guarantee data integrity, retention, or recoverability of any Content stored on our infrastructure.
  • Loss of data due to disk failure, RAID array failure, hardware failure, software failure, operating system corruption, security breach, user misconfiguration, ransomware, accidental deletion, service termination, or any other cause is the customer's responsibility.
  • Where AIC Cloud does perform internal backups for operational purposes, these backups are provided on a best-effort basis, may be incomplete, may have limited retention, and are not guaranteed to be restorable. Internal backups do not replace the customer's obligation to maintain independent copies of critical Content.
  • Restoration from any AIC Cloud internal backup, where available, may be provided as a paid service at our discretion, and delivery time is not guaranteed.
  • Customers running production workloads, business-critical data, or irreplaceable content are strongly advised to purchase a backup add-on and maintain off-site copies independently.

10. Acceptable Use & Prohibited Activities

Customers must not use AIC Cloud services for activities that are illegal, harmful, or violate the rights of others. Prohibited activities include but are not limited to:

  • Illegal activity of any kind under Indian or applicable local law
  • Fraud, phishing, or identity theft
  • Distribution of malware, viruses, or ransomware
  • Botnet operation, command-and-control infrastructure, or DDoS attack sources
  • Unauthorised network scanning, penetration testing of third-party systems, or exploitation attempts
  • Spam distribution, bulk unsolicited email, or SMS pumping
  • Hosting or distributing child sexual abuse material (CSAM) — reported to authorities on detection
  • Copyright, trademark, or intellectual property infringement
  • Cryptocurrency mining on shared or entry-tier VPS plans (dedicated servers and higher VPS tiers may allow this at our discretion)
  • Torrent trackers, warez distribution, or other bandwidth-abusing peer-to-peer usage on shared resources
  • Any activity that degrades service for other customers or threatens the stability of our infrastructure

AIC Cloud reserves the right to suspend or terminate services immediately upon detection of prohibited activity. No refunds will be issued in such cases, and any remaining wallet balance may be forfeited if the violation involves illegal activity.

11. Limitation of Liability

Under no circumstances shall AIC Cloud, its owners, employees, contractors, or partners be liable for:

  • Financial losses or lost revenue
  • Business interruption or loss of business opportunity
  • Loss of profits or anticipated savings
  • Loss, corruption, or unrecoverability of data or Content
  • Service interruptions, delays, or performance degradation
  • Indirect, incidental, special, consequential, or punitive damages
  • Damages caused by third-party actions, including but not limited to payment gateway failures, upstream network issues, or datacenter incidents

The maximum aggregate liability of AIC Cloud for any claim arising out of or in connection with the services shall not exceed the amount actually paid by the customer for the specific affected service in the one (1) month preceding the event giving rise to the claim. This limitation applies regardless of the theory of liability (contract, tort, statute, or otherwise) and even if AIC Cloud has been advised of the possibility of such damages.

12. Service Suspension & Termination

AIC Cloud reserves the right to suspend or terminate services with or without notice under the following circumstances:

  • Payments overdue beyond the grace period
  • Abuse, fraud, or violation of the Acceptable Use Policy
  • Threat to infrastructure security or stability of shared systems
  • Legal order, regulatory requirement, or law enforcement request
  • Scheduled or emergency maintenance
  • Chargeback initiation or payment dispute with the payment processor

Upon termination for any reason, all Content on the affected services may be deleted after a grace period of up to 14 days, at our discretion. Customers are responsible for retrieving their data before termination becomes effective.

13. Infrastructure Reliability Statement

AIC Cloud operates on enterprise-grade hardware across geographically distributed datacenters, with significant ongoing investment in reliability, security, and performance. While this minimises the likelihood of major failures, no infrastructure system can be considered completely immune to unexpected events, and this statement does not create any additional warranty, guarantee, or contractual obligation beyond what is expressly stated in these Terms.

14. Indemnification

You agree to indemnify, defend, and hold harmless AIC Cloud, its owners, employees, contractors, and partners from and against any claim, liability, damage, loss, or expense (including reasonable legal fees) arising out of or in connection with your Content, your use of the services, or your violation of these Terms.

15. Modifications to Terms

AIC Cloud reserves the right to modify these Terms at any time. Updated Terms will be published on this page with a revised "Last updated" date. Continued use of the services after such changes constitutes acceptance of the updated Terms. For material changes, we will make reasonable efforts to notify active customers via email or dashboard notification.

16. Governing Law & Jurisdiction

These Terms shall be governed by and interpreted under the laws of India. Any disputes arising out of or in connection with these Terms or the services shall fall under the exclusive jurisdiction of the courts located in Gautam Buddha Nagar, Uttar Pradesh, India.
